The Board of Directors of the Sonara at Malibu Bay Neighborhood Association Inc. (the “Association”) has developed a policy based on the Association’s documents and applicable Florida Statutes. The general policy statement is there is no parking in the street, and/or swale/berm grass (strip between sidewalk and street), and/or while blocking the sidewalk by any vehicle.
Specifically:
1. All parking on the street must be in the direction of traffic flow.
2. Owners and residents must not park on the street overnight. Overnight is considered to be hours of darkness.
3. All owners and residents may park in their garages, driveways and the concrete portion of the swale parallel to the road. Parking may not be done on any grass nor in a way to block the sidewalk. Guests must park in any of the spaces noted above.
4. Parking on the swale/berm grass is prohibited and grounds for violations: fines and/or towing. The most favorable result to correct a common-area parking violation is to achieve voluntary compliance by the homeowner and/or vehicle driver and/or owner. It is the intent of the Board to have a fair and equally-applicable policy, which provides reasonable time to correct community standard
violations as well as considering both individual situations and the community at large.
The following constitutes the Association’s procedures regarding common area parking violations:
• 1st Incident – Warning Notice placed on Automobile – Management Company will record date, general location, make & model of vehicle, and license tag number.
• 2nd Incident - Warning Notice placed on Automobile’s Window – Management Company will record date, location, make & model of vehicle, and license tag number.
• 3rd Incident – Management Company personnel or authorized persons authorized by the Association (to be determined from time to time) will order the vehicle to be towed from the Community by a Licensed and Insured Towing Company – as contracted by the Association – at the owner’s expense.
Notes:
1. Vehicle covenants, codes, restrictions regarding private property (one’s own lot) i.e. parking on own grass, commercial vehicles, other prohibited vehicles and activities, etc.; will come under the separate Violations process and option to appear before Grievance Committee when escalated up through monetary fines in accordance with Sonara CCRs and Florida Statutes.
2. A homeowner should always use discretion in dealing with unauthorized vehicles parked on their own private property. It is not an Association matter.
3. Prohibited vehicles are defined in 12.4.3 of the Declaration for Sonara at Malibu Bay including boats, trailers, recreational vehicles, campers, limousines, etc. which are entirely or partly visible from common areas (i.e. streets). For more information, do refer to section 12.4.3
